The Royal referral to the Higher Council of Ulema regarding certain proposals of a religious nature, brought to the High Appreciation of His Majesty King Mohammed VI by the Body in charge of revising the Family Code, reaffirms the Sovereign's commitment to a reform that guarantees the rights of all family members, taking into account the virtues of Ijtihad in the service of society as a whole, said Atika Ellouaziri, lawyer and human rights activist. In a statement to MAP, she noted that the Royal referral to the Higher Council of Ulema falls within the framework of the constitutional prerogatives of this institution, which has exclusive authority to issue Fatwas based on the principles of openness and constructive Ijtihad. Ellouaziri added that the Royal referral contains clear guidelines for the Higher Council of Ulema, with a view to finding innovative solutions that are in line with the spirit of Sharia and aim to guarantee justice and equity between the components of the family, in order to accompany so cietal developments in the light of women's contribution to the development of the family and society. HM King Mohammed VI, may God assist Him, Chairman of the Higher Council of Ulema, has kindly given His High Directives to the said Council, to examine certain questions contained in the proposals of the Body in charge of revising the Family Code, with reference to the principles and precepts of the holy religion of Islam and its purposes, and to submit a Fatwa on their subject to the Sovereign's High Appreciation.
